Waiver and Member Agreement

1) Because physical exercise can be strenuous and subject to risk of serious injury, you are strongly urged to obtain a physical examination from a doctor before using any exercise equipment or participating in any exercise activity. You agree that if you engage in any physical exercise or activity at X Fitness Welland Inc., you do so entirely at your own risk. You agree that you are voluntarily participating in the use of X Fitness Welland, Inc. and assume all risks of injury, illness, or death. You acknowledge that you are responsible for any loss or damage of/to your personal property.

2) This waiver and release of liability includes, without limitation, all injuries which may occur, regardless of negligence, as a result of:

(a) your use of all amenities and equipment in X Fitness Welland Inc. and your participation in any activity, class, program, personal training or instruction,

(b) the sudden and unforeseen malfunctioning of any equipment and

(c) your slipping and/or falling while at X Fitness Welland Inc., including adjacent sidewalks and parking areas.

3) You acknowledge that you have carefully read this "waiver” and fully understand that it is a release of liability. You expressly agree to release and discharge X Fitness Welland Inc., 44 Division Street, Welland Ontario, and its affiliates, employees, agents, representatives, successors, or assigns, from any and all claims or causes of action for negligence, personal injury or property damage.

4) You have agreed to purchase a membership at a facility that allows you access at any time. As such, you are aware that there will be no supervision or assistance during specific times. You are also aware that if you are injured, there will likely be no one to respond to your emergency and X Fitness Welland Inc., has no duty to provide assistance to you. Even though X Fitness Welland Inc., is equipped with surveillance cameras, it is likely that should you require immediate assistance, none will be provided. We recommend that you have a workout partner accompany you while at X Fitness Welland Inc., when staff is absent, but it is entirely up to you.

5) You will use your access card to gain entry into X Fitness Welland Inc., for yourself and no other individual(s). You will not allow anyone to enter with you when you gain entry by using your access card. When the door is shut and locked, you will ensure that it is shut and locked after you enter and again when you exit. When the door is propped open, you will swipe your card, even though it is not required to gain entry, in order that your visit can be recorded for auditing purposes.

6) You agree to restrict your movements to the member-designated areas of the gym. You will not enter or attempt to enter any restricted areas of X Fitness Welland, Inc., that being, but not limited to offices, staff room, storage areas or the area behind the front desk.

7) You will advise X Fitness Welland Inc., of any change in your personal information, specifically address or phone number.

8) Memberships are non-refundable after 5 days from date of purchase and are non-transferable.

9) You agree to adhere to X Fitness Welland Inc.’s Equipment Policies including wearing clean shoes, using equipment properly and not dropping/throwing weights. Failure to do so may result in membership termination at X Fitness Welland Inc.’s management discretion.
